U.S. District Court Judge Joyce Hens Green, a Carter appointee, has ruled that the military tribunal procedures are unconstitutional and terrorism suspects at Guantanamo Bay can challenge their confinement. The tribunals, or military commissions, were implemented because of the "enemy combatant" status of the prisoners at Guantanamo. But Judge Joyce Hens Green ruled that these "enemy combatants" have constitutional protections under U.S. law. In fact, even though these terrorists do not have "prisoner of war" status under the Geneva Convention, Judge Joyce Hens Green effectively extended "prisoner of war" status to them via judicial fiat. Making America safer... for terrorists to operate... your federal judiciary is hard at work!
